ART AUCTION TERMS AND CONDITIONS
These terms apply to artworks offered as part of the Fizz Gallery Auction held between Saturday 12th September 2026 and Monday 14th September 2026.
By submitting a bid, you confirm that you have read and agree to these terms.
1. The Auction
Each artwork will be available for bidding for the duration of the auction period.
The auction period will start at 6pm (BST) on Saturday 12th September 2026 and close at 5pm (BST) on Monday 14th September 2026. Bids received after the closing time of the auction will not be valid.
2. Reserve Prices
Each artwork will have a reserve price. The reserve is the minimum price Fizz Gallery will accept for that artwork. A bid must meet or exceed the stated reserve to be considered.
If no bid meets the reserve by 6pm (BST) on Monday 14th September, the artwork will remain unsold.
3. How to Bid
Bids must be submitted by completing the bid submission form on our website.
You will need to provide the following information with your bid:
- your full name
- your contact details
- the name or reference of the artwork
- the amount you wish to bid
Bids must be made in pounds sterling (£).
It is the bidder’s responsibility to make sure their bid reaches Fizz Gallery before the auction closes.
4. Bidding
Please only submit a bid if you genuinely intend to purchase the artwork at the amount bid.
FIZZ Gallery will consider a bid a binding agreement to purchase the item and will issue an invoice to the highest bidder.
Fizz Gallery may disregard a bid where it is incomplete, received after the closing time, appears fraudulent or has clearly been submitted in error.
If you wish to change your bid before the auction closes, please submit a new bid using the bid submission form. Your most recent valid bid will be treated as your current bid.
5. The Winning Bid
At the end of the auction, the highest valid bid that meets or exceeds the reserve price will be the winning bid.
If two bidders submit the same highest bid, the bid received first will take priority.
The successful bidder will be contacted by Fizz Gallery using the contact details supplied with their bid within 48 hrs of the close of the auction.
A sale will not be confirmed until Fizz Gallery has notified the successful bidder that their bid has been accepted and full payment received.
6. Payment
The successful bidder must make full payment within 48 hours of being notified that they have won the artwork.
Payment instructions will be provided when the successful bidder is advised that they have won the bidding.
If payment is not received within this period, Fizz Gallery reserves the right to cancel the sale and offer the artwork to the next highest qualifying bidder.
7. Collection / Delivery
All items included in the auction are done so on the basis that they will be collected from the gallery once purchased.
If you are unable to collect your artwork, we may be able to arrange delivery to mainland UK at an additional charge. Please contact us to discuss delivery options and obtain a delivery quote prior to placing your bid.
8. Artwork Descriptions and Condition
Fizz Gallery will make every reasonable effort to describe and photograph each artwork accurately.
Where relevant, information about the artist, dimensions, medium, framing and condition will be included with the artwork. Each piece will be considered to be framed unless otherwise stated.
Prospective bidders are welcome to contact Fizz Gallery before bidding if they would like further information about a piece.
Nothing in these terms affects your statutory rights where an artwork is faulty, damaged or materially different from its description.
9. Returns & Refunds
Items included within the auction are non-returnable or refundable – except where your statutory rights apply.
10. Withdrawal of an Artwork
In exceptional circumstances Fizz Gallery may withdraw an artwork before the auction closes, for example if the artwork becomes unavailable, is damaged or there is a significant error in its listing.
If this happens, any bids already received for that artwork will no longer apply.
11. Technical Problems
Fizz Gallery cannot guarantee uninterrupted access to email or the website.
If there is a significant technical problem that prevents bids from being received fairly, Fizz Gallery may extend or rerun the auction for the affected artwork.
12. Personal Information
Information supplied by bidders will be used to administer the auction, contact successful bidders and complete any resulting sale.
Personal information will be handled in accordance with Fizz Gallery’s Privacy Policy.
